Introduction
These General Terms and Conditions of Sale ("Terms") govern the sale of products by MyKendi Ltd, trading as Kendi,
through the Kendi website (the "Website"). By purchasing from the Website, you agree to be bound by these Terms. The
seller and contractual party for all sales is MyKendi Ltd, a company registered in the UK.
Article 1. Scope of Application
1.1 Any sale made through the Website constitutes a distance contract governed by applicable British law, including the
Consumer Rights Act 2015, UK and EU consumer protection regulations, and relevant trading standards.
1.2 These Terms apply to all purchases made via the Website by consumers or professionals.
1.3 Consumer means a natural person acting outside their trade, business, or profession. Professional refers to a
person acting in a commercial or professional capacity.
1.4 References to days mean business days, excluding weekends and public holidays.
1.5 Product images are for illustration purposes only and actual product colors may vary due to screen settings.
1.6 Kendi may update these Terms at any time. The version in effect at the time of purchase will apply.
1.7 These Terms do not apply to sales by third parties linked on our Website.
1.8 Kendi is not responsible for third-party websites, products, or services.
1.9 Users must read these Terms carefully before purchasing.
1.10 Kendi is not liable for indirect or incidental damages resulting from Website use.
1.11 All Website content is owned by Kendi or its licensors and may not be reproduced without written permission.
Article 2. Purchases on the Website
2.1 Orders are finalized when they reach Kendis server.
2.2 You agree to notify Kendi of any unauthorized use of your personal information.
2.3 You are responsible for the accuracy of the personal information provided.2.4 Kendi may cancel or refuse orders for various reasons including legal disputes or incomplete data.
2.5 Submitting an order implies acceptance of these Terms.
2.6 The sales contract is between you and MyKendi Ltd.
2.7 References to "Kendi" or "we" include MyKendi Ltd.
2.8 We do not guarantee continuous Website availability.
2.9 Order confirmation emails will include order details and delivery info.
2.10 Colors may appear differently on screen than in reality.
Article 3. Product Availability
3.1 Products are offered in limited quantities and may become unavailable after order placement.
3.2 Availability is updated regularly, but discrepancies may occur.
3.3 If an item is unavailable, you may receive a refund or alternative product.
3.4 Refunds are processed within 10 days.
3.5 The contract is voided if unavailable products cannot be supplied.
3.6 Pre-orders require upfront payment and are dispatched within 30 days of availability.
3.7 Gift cards are non-refundable, non-transferable, and not exchangeable for cash.
Article 4. Prices
4.1 Prices include VAT unless stated otherwise (e.g., for non-EU deliveries).
4.2 Product prices may change but the order price is fixed at checkout.
4.3 Shipping costs are disclosed during checkout.
4.4 Ownership passes on shipment; risk passes on delivery.
4.5 Orders may be canceled if payment is not completed.
4.6 Pricing errors may result in order cancellation or price adjustment.
Article 5. Payment Methods
5.1 Kendi accepts major credit cards and ApplePay. Secure authentication may be required.5.2 Payments via PayPal and Klarna are also accepted under their respective terms.
5.3 Refunds are processed using the original payment method.
Article 6. Delivery of Products
6.1 Products can be shipped to the UK, EU, USA, Switzerland, and GCC countries.
6.2 Delivery is deemed complete once the product is in your possession.
6.3 Standard delivery time is 14 days; a maximum of 30 days.
6.4 You are advised to inspect goods upon receipt.
6.5 Non-collection may result in contract termination and associated fees.
Article 7. Right of Withdrawal
7.1 Only Consumers may withdraw from the purchase within 60 calendar days.
7.2 To withdraw, contact Kendi before the withdrawal period expires.
7.3 Return costs are borne by the Consumer.
7.4 Refunds are issued within 14 days of return.
7.5 Products must be returned in original, unused condition.
7.6 A deduction may be applied for decreased value due to use.
7.7 Withdrawal does not apply to partial products or accessories.
7.8 Exchanges require withdrawal and a new purchase.
Article 8. Legal Warranty
8.1 Consumers are protected by a 2-year legal warranty.
8.2 Faults arising within 12 months are presumed pre-existing unless proven otherwise.
8.3 Remedies include repair, replacement, or refund.
8.4 Warranty does not cover misuse or damage due to external causes.
8.5 Professionals are subject to different legal terms.
8.6 Product recalls will be managed per applicable EU and UK laws.
Article 9. Applicable Law and Jurisdiction
9.1 These Terms are governed by British law, including but not limited to the Consumer Rights Act 2015, the UK
General Data Protection Regulation (UK GDPR), and any applicable European Union consumer law where relevant.
9.2 Consumers may bring claims in their country of residence.
9.3 ADR and ODR procedures are available for unresolved disputes.
9.4 Visit http://ec.europa.eu/consumers/odr/ for EU ODR services.
9.5 Consumers retain the right to bring court action at any time.
9.6 Small claims procedures are available for EU customers for claims under 5,000.
Article 10. Reviews
10.1 Reviews may not always be verified purchases.
10.2 Incentivized or sponsored reviews will be clearly labeled.
